This seminar will assist you to keep abreast of changes in procedure and practice which affect civil litigation in the Sheriff Courts in Scotland. It will discuss recent decisions which affect the interpretation of procedural rules. It will look forward to possible areas of change canvassed in the Civil Justice Review. It will cover Ordinary (non family) actions, personal injury actions, Commercial action, Summary causes and Small Claims.

OBJECTIVES There have been significant changes in Court Rules and Procedures over the last 10 years. These will continue and, under the Civil Justice Review, the role of the Sheriff Court may well become much more significant for litigation in Scotland. The different procedures followed in the Sheriff Court will come under scrutiny and an appreciation of their application in practice at present is essential to understand their likely development in the future. The seminar will deal particularly with:
- Recent changes in rules and practice
- Changes in jurisdiction limits
- Recent cases on Ordinary actions
- The inherent jurisdiction of the courts to regulation procedure
- Commercial Actions in the Sheriff Court
- Summary Decree
- The impact of the Human Rights Act on procedure
- Personal Injury litigation
- The role and content of written pleadings; written submissions and arguments
- Cases on Summary Causes and Small Claims procedure
PARTICIPANTS This seminar is aimed at all lawyers involved in civil litigation in the Sheriff Court. Family actions will not be considered. It will be assumed that delegates have practical experience of Sheriff Court actions and knowledge of the basic rules of procedure.
SPEAKER The speaker is Charles Hennessy, Senior Partner, Charles Hennessy & Co., Glasgow. He is a Solicitor Advocate. He is a visiting Professor at Glasgow Graduate School of Law. He has lecturered and tutored extensively in civil litigation for many years. He is the author of "Civil Procedure and Practice" in Greens Concise Scots Law Series, and of "Practical Advocacy in the Sheriff Court".
